Bill Requiring Out-Of-State Contractors Registry Advances
Legislation (A-2078) that requires the State Treasurer to establish a public registry for out-of-state contractors awarded public works contracts was released from the Assembly Commerce and Economic Committee and now awaits consideration by the full Assembly. The Senate companion bill, S-3131, awaits consideration by the Senate State Government, Wagering, Tourism and Historic Preservation Committee.
A-2078 requires the State Treasurer to establish and maintain an up-to-date and public registry of out-of-state contractors who are awarded public works contracts subject to the Prevailing Wage Act. The registry must include the trade name, owner’s name, principal business address, and description of the public works project. The registry must be available on the State Treasurer’s website and must be provided in print or electronic to any contractor, out-of-state contractor or public body upon request.
A-2078 defines “out-of-state contractor” as a contractor, including subcontractors, whose principal place of business is not in New Jersey. A principal place of business does not include a satellite office, an office maintained, occupied, and used by an out-of-state contractor only for the duration of a contract, or an office maintained, occupied, and used by a person affiliated with an out-of-state contractor.
The League opposes the bill as the Business Registration Certificate (N.J.S.A. 52:32-44) provides the State Treasurer with the information required by A-2078, except the project the out-of-state contractor has performed for a public entity. However, that information is provided to the Department of Labor when filing certified payroll records through the New Jersey Wage Hub.
