Senate Community and Urban Affairs Committee Advances S-4787

Last Thursday, the Senate Community and Urban Affairs Committee favorably reported S-4787, which provides for certain energy storage projects to be considered “inherently beneficial use” under the Municipal Land Use Law (MLUL). 

This legislation amends the definition of an “inherently beneficial use” in the MLUL (C.40:55D-1 et seq.) to include projects under or eligible to receive certain incentives from the New Jersey Board of Public Utilities (BPU) pursuant to an energy storage program. The bill outlines “energy storage program” as the BPU’s Successor Solar Incentive Program, including the Competitive Solar Incentive Program, the program established pursuant to P.L.2025, c.136, the Garden State Energy Storage Program, or any other programs. 

The bill is on second reading in the Senate, and we will continue to advise you on developments.
