The memorandum, sent to assignment judges and municipal court presiding judges, states that Guideline 4, which prohibits all plea agreements whatsoever in drunken driving or certain drug offenses, remains in effect.
The memorandum comes after a new law signed last year meant to allow the use of plea bargaining in minor DUI cases.
In the memorandum, Judge Grant further states “If a challenge to Guideline 4 is raised in any municipal court case, please immediately bring that to my attention.”
Municipal judges and court staff should be aware of the memorandum.
