On Monday, the League testified before the Assembly Housing Committee in opposition to three bills that would preempt local planning and permit the development of accessory dwelling units (ADUs) on property zoned for single- or two-family residential uses.
The Committee merged the three bills into ACS for A-22792, A-4370 and A-2489 , but did not advance the bill out of committee.
At the same hearing, the Committee did advance A-4913, sponsored by Speaker Coughlin and Assemblywoman Speight, which would establish State funding incentives and preferences for municipalities that amend its master plan to incorporate housing strategies, including ADUs. The important distinction is that A-4913 does not preempt local zoning. The League did not take a position on the bill in committee, but noted appreciation of the incentive approach. We expect to meet with legislative staff and relevant State agencies on the legislation in the upcoming weeks. A-4913 was then referred to the Assembly Appropriations Committee for further consideration. To date, there is no Senate companion.
