Affordable Housing Deadline

In response to several questions and inquiries on the upcoming filing deadlines for municipalities, we are providing this notice and reminder.  

Municipalities preparing to either accept the housing obligation numbers prepared by the Department of Community Affairs (DCA) or modify those numbers based on other factors are required to file by the end of the month.  

The statute requires that the adopted binding resolution be posted on the municipality’s official website, if it has one, within 48 hours of adoption. Your attorney should then submit the resolution with a Declaratory Judgement action, also within 48 hours of adoption.    

No newspaper publication or other publication is required for the municipality.   

The “Program,” administered within the Court system, will then upload it on its website, along with the filing date.
