Governor Signs Bill Requiring Online PWCR & Payroll Certificates

Governor Murphy signed into law S-1442/A-5345, which requires public works contractor registration and payroll certification for public works projects to be completed online. P.L. 2023, c. 138 will take effect next year on August 16, 2024.   

The new law will require contractors to complete their Public Works Contractor Registration electronically using an online form from the Department of Labor. The form will also include a certification for the Registered Apprenticeship program.  

In addition, the new law requires that the Department of Labor provide a web based secure process for the online submission of certified payroll records and a secure process for the inspection of those records, in full and without redaction, by the public body awarding the contract, any other party to the lease or agreement to the lease to which the public work is done and the Commissioner of Labor. Department of Labor will be required to post the certified payroll records to their website, however, the addresses and social security numbers of the workers will be redacted.   

Contractors and subcontractors will be required to submit certified payroll records to the public body awarding the contractor within 10 days from the date the employees were paid their wages. The certification must be the original, unredacted certified payroll record. 

This new law will take effect on August 16, 2024.
