Governor Signs Parental Notification Legislation

Earlier today, Governor Murphy signed S-5472/S-3565 requiring law enforcement to provide a parent, guardian or other person having legal custody of a person under the age of 18 with a written notification for any violation for underage consumption or possession of alcohol, cannabis item, marijuana or hashish. In addition, if an underage person is in possession of or consumes alcohol, marijuana, hashish or cannabis item, the law prohibits transporting them to a police station, headquarters, or other place of law enforcement operations or detain them except to the extent required to issue a written warning or collect information necessary to provide notice to their parent or legal guardian. This new law took effect immediately.
