Supreme Court Upholds Eminent Domain in Mount Laurel vs. MiPro Homes

The New Jersey State League of Municipalities is very pleased to report that the New Jersey Supreme Court today ruled in favor of Mount Laurel Township in the case of Mount Laurel vs. MiPro Homes.

The ruling upholds the right of the municipality to exercise eminent domain powers in order to preserve open space, even where there is no plan to create active recreation areas.  The Supreme Court upheld the Appellate Division ruling and the well established public policy in New Jersey in favor of open space preservation.

The League participated in the case as Amicus Curiae and special thanks go to Thomas G. Dunn, Esquire, who wrote the briefs and argued the case on behalf of the League in both the Appellate Division and the Supreme Court.
