RE: IMPORTANT NOTICE ON PENSIONS AND BENEFITS
FOR NEWLY ELECTED AND
The Division of Local Government Services (DLGS) in the Department of Community Affairs (DCA) has just released the long-awaited Local Finance Notice that details the impact that Chapter 92 (P.L. 2007, c.92) will have on newly elected officials; newly appointed officials; professional service contractors who are also employees; how certain employees are affected by the new Defined Contribution Retirement Program; and how those and other employees are affected by limits on using sick or vacation time as retirement leave.
This is a very important issue and may have an impact on actions your governing body may take at its first meeting in January. We urge that the CFO, Clerk, and Chief Administrative Officer review the Notice immediately, and that it be shared with local unit legal advisors and other appropriate personnel in your organization, and that its impact be reviewed with the governing body as soon as possible.
Also released is a summary of actions the chief financial officer or other appropriate individual should take to implement the provisions of the law.
