LEAGUE PARTNERS WITH DOT
ON PROPOSED TRUCK REGULATIONS

The United States Court of Appeals for the
Third Circuit ruled against the State of New Jersey in its
appeal of the prior District Court decision in the case
of American Trucking Association, et al. v. Whitman, et
al. The Court found that the challenged truck routing rules
unconstitutionally discriminated against out of state truckers.
The League had intervened as amicus curiae, or Friend of
the Court, to support the state's appeal in this case. The
State has moved to appeal this devastating ruling.
In the interim, the New Jersey Department
of Transportation has filed emergency regulations putting
back in place the "pre-1999" truck routing rules
in response to the court decision. A copy of the rules is
available at the Department's website at http://nj.gov/transportation/
The League is working with the Department to fashion new
regulations that will be constitutional and protect the
safety of New Jersey residents. We will keep you informed
of further developments.

The Awards for Municipal Excellence recognize
outstanding programs that have improved the quality of life
in America's communities. Given through a partnership between
the National League of Cities (NLC) and CH2M HILL, the Awards
honor a range of population sizes, with two awards in each
population category.
Nominated programs will be judged on several
criteria, including: successful public-private partnership
ventures; productive citizen and community collaborations;
effective management of municipal resources (public or private);
innovative government policies; project implementation with
tangible results; and the ability to replicate the project
in other cities.
Nomination forms are available, and the
deadline for submission is June 21, 2006. Up to eight winners
will be nationally recognized at a ceremony at NLC's Congress
of Cities Conference and Exposition in Reno, NV, December
2006.

In January, all mayors received information
on the Louis Bay II Future Municipal Leaders Scholarship
competition.
By April 7, you should have submitted your
local winner to the League office along with a tally of
your local entries. The League judging panel includes Scholarship
Chairwoman Mayor Phyllis Marchand of Princeton Township,
Mayor Daniel Van Pelt of Ocean Township, and League staff
members Helen Yeldell and Deborah Kole.
On May 5, winners are announced and checks
are sent to the respective winners' mayors for formal presentations.
The top three winners each receives $1,000 scholarships
provided by the League for presentation by the hometown
mayors.
STATE TRANSFER OF DEVELOPMENT
RIGHTS PROGRAM

The League and Association of New Jersey
Environmental Commissions will co-sponsor two workshops
on the State Transfer of Development Rights (TDR) Program.
Each workshop will include a discussion of resource-based
land use planning and how to set up a TDR program based
on the new state TDR law. In addition, New Jersey's regional
TDR programs will be discussed and a case study of an actual
TDR program will be presented (northern location will discuss
Highlands Council program and southern location will discuss
Pinelands Commission program). Speakers include land use
professionals with expertise in TDR from throughout the
state. The programs will held on April 29 at Morris County
Cultural Center and May 6 at Cumberland County College.
Each session will be approximately five hours. For more
information on how to register, contact Joy Farber at ANJEC.

Governor Corzine's first
State budget includes some troublesome spending cuts and
tax increases. As always, the first concern of local officials
has to be property tax relief funding.
Formula funding will not be
going down. You can anticipate the same amount you received
in FY '06 through all the major general property tax relief
programs. But, Extraordinary Aid funding, which is annually
awarded, based on need and the availability of funding,
will be $13 million less than the current level. And, for
yet another year, local property taxpayers will be denied
the annual inflationary adjustments that are required by
State statute in both CMPTRA and ETR/PTR funding. We hope
that legislators recognize how "level funding"
contributes to the problems being faced by local budget
makers and property taxpayers.
We appreciate the struggle
to responsibly close a massive, inherited deficit. We, likewise,
appreciate the Governor's renewal of his promise to advance
the cause of long term property tax reform, as soon as an
agreement is reached on the FY '07 spending plan; as well
as his commitment to anti-gang/anti-youth violence initiatives.
We will soon present our testimony
on the proposal to the Legislature's budget writing committees.

The League had intervened as amicus curiae, or Friend of
the Court, to support the state's appeal in this case. The
State has moved to appeal this devastating ruling.
In the interim, the New Jersey Department
of Transportation has filed emergency regulations putting
back in place the "pre-1999" truck routing rules
in response to the court decision. A copy of the rules is
available at the Department's website at http://nj.gov/transportation/
The League is working with the Department to fashion new
regulations that will be constitutional and protect the
safety of New Jersey residents. We will keep you informed
of further developments.

The Awards for Municipal Excellence recognize
outstanding programs that have improved the quality of life
in America's communities. Given through a partnership between
the National League of Cities (NLC) and CH2M HILL, the Awards
honor a range of population sizes, with two awards in each
population category.
Nominated programs will be judged on several
criteria, including: successful public-private partnership
ventures; productive citizen and community collaborations;
effective management of municipal resources (public or private);
innovative government policies; project implementation with
tangible results; and the ability to replicate the project
in other cities.
Nomination forms are available, and the
deadline for submission is June 21, 2006. Up to eight winners
will be nationally recognized at a ceremony at NLC's Congress
of Cities Conference and Exposition in Reno, NV, December
2006.

FUTURE MUNICIPAL LEADERS
SCHOLARSHIP COMPETITION DEADLINE

In January, all mayors received information
on the Louis Bay II Future Municipal Leaders Scholarship
competition.
By April 7, you should have submitted your
local winner to the League office along with a tally of
your local entries. The League judging panel includes Scholarship
Chairwoman Mayor Phyllis Marchand of Princeton Township,
Mayor Daniel Van Pelt of Ocean Township, and League staff
members Helen Yeldell and Deborah Kole.
On May 5, winners are announced and checks
are sent to the respective winners' mayors for formal presentations.
The top three winners each receives $1,000 scholarships
provided by the League for presentation by the hometown
mayors.
STATE TRANSFER OF DEVELOPMENT
RIGHTS PROGRAM

The League and Association of New Jersey
Environmental Commissions will co-sponsor two workshops
on the State Transfer of Development Rights (TDR) Program.
Each workshop will include a discussion of resource-based
land use planning and how to set up a TDR program based
on the new state TDR law. In addition, New Jersey's regional
TDR programs will be discussed and a case study of an actual
TDR program will be presented (northern location will discuss
Highlands Council program and southern location will discuss
Pinelands Commission program). Speakers include land use
professionals with expertise in TDR from throughout the
state. The programs will held on April 29 at Morris County
Cultural Center and May 6 at Cumberland County College.
Each session will be approximately five hours. For more
