RE: Lame Duck Update

Dear Mayor:

Barring any unexpected developments, the Legislature will next meet on January 4, 2010. Here is an update on some bills that have recently moved and some, just introduced that may move rapidly, after the New Year.

A-289 - Makes public officers or employees convicted of certain crimes or found at fault in certain civil actions liable and subject to pension garnishment for public legal expenses and illegally obtained funds.
The League supports this bill, which awaits action on the Assembly Floor.

A-351 - Permits nonpartisan municipal elections to be held on same day as general elections.
The bill was amended in the Senate; to clarify the transition period and how often municipalities can change from the election day.  The League supports this amended bill, which awaits final action on the Assembly Floor.

A-436 - Permits price adjustments in local public contracts for asphalt cement and fuel.
We have asked for an exception for projects of a short duration. Pending that, we oppose the bill, which awaits final action in the Assembly.

A-557/S-2336 - Repeals bidding requirement for local public contracts to allow bidders to avoid unresponsive bid if they inadvertently omit business registration from bid proposal provided that bidder was registered before bid submission deadline.
The League supports this bill, which awaits final action on the Senate Floor.

A-931 - Clarifies immunity from civil liability for volunteers affiliated with Citizen Corps under certain circumstances.
The League supports this bill, which has passed the Assembly. It is now in the Senate Judiciary Committee, where it joins its companion, S-2167.

A-1619 - Revises certain statutes concerning sale of tax and other municipal liens.
The League supports this bill, which awaits final action on the Senate Floor.

A-1882/S-1807 - Permits three year payoff of accumulated deficits of municipal health insurance funds.
The League supports this bill, which awaits action on the Senate Floor.

A-2185 - Provides exceptions for removal of snow and ice from certain parking spaces within 24 hours after inclement weather or state of emergency.
The League opposes this bill, which could impose increased monitoring and enforcement duties on a municipality. It has passed the Assembly and been referred to the Senate Transportation Committee.

A-3396/S-2304 - Provides authorized emergency vehicles protection under lemon law.
The League supports this bill, which awaits action on the Senate Floor.

A-4247 - Permits municipalities to auction taxi licenses to highest bidder, requires taxicabs to post taxi license number and name of licensing municipalities on exterior, and requires drivers of taxicabs to submit to criminal history record background checks.
The League supports this bill, which has passed the Assembly. It now awaits action in the Senate Transportation Committee.

A-4198/S-12 - Addresses various concerns affecting post-release employment.
The League opposes this bill which conflicts with existing labor law and would open municipalities to lawsuits from prospective employees. It awaits action in the Assembly Law and Public Safety Committee and its companion bill, S-12, awaits action in the Senate Law and Public Safety Committee.

S-2382 - Clarifies that a county and another local unit of government may enter into shared services agreement for the county to provide a service that the local unit may provide.
The League supports this bill, which awaits action on the Senate Floor. A companion measure, A-3505 has been referred to the Assembly Housing and Local Government Committee.

S-2528 - Provides for regulation of small wind energy systems by municipalities.
The League opposes this bill, which removes local control and discretion. It now awaits action on the Senate Floor. Its companion, A-3740, has been referred to the Assembly Housing and Local Government Committee.

S-2856 - "New Jersey Public Water Supply Fluoridation Act."
The League opposes this costly mandate, which has been second referenced to the Senate Budget and Appropriations Committee .Its companion, S-3709, has been referred to the Assembly Appropriations Committee.

S-2859 - Concerns collateral of public depositories under "Governmental Unit Deposit Protection Act."
The League supports this bill, as amended. It awaits action on the Senate Floor. Its companion, A-3998, awaits action on the Assembly Floor

S-2985 - Extends requirement of wastewater management planning agencies to establish or update wastewater management plans, and extends validity of sewer service areas and wastewater service areas, until April 7, 2012.
The League supports this bill, which currently awaits action on the Senate Floor.  Its companion, A-4257, has been referred to the Assembly Environment and Solid Waste Committee.

S-3094 - Concerns apprenticeship programs and other standards for public works contractors.
The League opposes this bill, which awaits action on the Senate Floor.  The bill would increase cost of any public works project.
