RE: Federal Trade Commission (FTC) Delays Red Flag Rule (again)

Dear Mayor:

The Division of Local Government Services (DLGS) has asked us to inform you that the Federal Trade Commission (FTC) has announced that it is delaying the implementation of the "red flag" identity theft rules until June 1, 2010.  Details on the delay are at: www.ftc.gov/opa/2009/10/redflags.shtm

The Red Flags Rule require many businesses and organizations to implement a written Identity Theft Prevention Program designed to detect and respond to the warning signs – or "red flags" – of identity theft in their day-to-day operations.

Information on their impact on New Jersey local units is found in Local Finance Notices 2009-9R on the Local Finance Notice page at www.nj.gov/dca/lgs/lfns/lfnmenu.shtml.

The National League of Cities (NLC) has been very active in limiting the impact of these rules on local governments and in supporting delays, until all issues are worked out.

Very truly yours,

William G. Dressel, Jr.
Executive Director
