Re: Important New Information from the Division of Local Government Services

Dear Mayor:

We would like to draw your attention to some important new information on the website of the Division of Local Government Services.

1. The Public Employment Relations Commission is required to adopt temporary rules to implement the provisions of L.2009, c.16. That law allows non-Civil Service law enforcement officers and firefighters who are terminated pursuant to a complaint or charges not involving any alleged violation of criminal law, to have the option of having their terminations reviewed by means of binding arbitration. Review through binding arbitration is an alternative to review through a proceeding in the Superior Court pursuant to N.J.S.A. 40A:14-22 pertaining to firefighters, and N.J.S.A. 40A:14-150 pertaining to law enforcement personnel. The new statute is applicable to terminations for non-criminal conduct in which the underlying conduct occurs after June 1, 2009.

2. The State's Minicomputers, Microcomputers, Workstations and Associated Products Term Contract (T0483), commonly referred to as the "Mini-Micro Contract", expired in its entirety on December 31, 2008.  Therefore, State agencies, local government agencies and any other member of the Cooperative Purchasing Program including but not limited to schools, are prohibited from purchasing goods and/or services from this expired contract.  Additionally, vendors contractors are prohibited from offering good and/or services under their expired Mini/Micro Contract, and vendors may not reference the former Mini/Micro contract number on price quotes to agencies.

The State has issued new term contracts, which are available for use by both State agencies and Cooperative Purchasing Partners, to supplant the items previously available under the Mini/Micro Contract.  The new contracts are as follows:
