Dear Mayor:
Today in Trenton,
Governor McGreevey met with a delegation of local leaders,
including Mayors Ron Sworen of Frenchtown and David DelVecchio
of Lambertville (the co-chairs of our Heavy Truck Task Force),
and Mayors Jo-Anne Schubert of South Bound Brook (our League
President), Peter Cantu of Plainsboro (our First Vice President),
and others, to develop a coordinated response to the recent
District Court decision on the regulation of heavy truck
traffic on local and secondary roads. (See
our letter of March 25 for more details.)
While we oppose
the Judge's reasoning, which led him to invalidate these
vital safety regulations, we are gratified with his decision
to stay his ruling, pending appeal. Because of that, the
rules remain in effect and they will be enforced.
We are thankful
that the Governor has decided to appeal the decision and
has pledged to fight all the way to the U.S. Supreme Court,
if need be. The League intends to join in the appeal and
to remain active until this litigation is resolved. The
Governor, also, will ask Department of Transportation Commissioner
Jack Lettiere and State Police Superintendent Rick Fuentes
to reconvene the State's "Truck Task Force." The
League will be represented on and participate in the deliberations
of that task force.
And in an important
related development, today, in Washington, New Jersey Congressman
Rush Holt introduced an amendment to H.R. 3550, the "Transportation
Equity Act: A Legacy for Users" (TEA-LU), which would
codify a State's authority to enact and enforce heavy truck
traffic regulations, for the safety of the public.
