Re:  COAH Update

Dear Mayor:

As referenced in our Dear Mayor letters of January 3, 2008 and December 18, 2007, the Council on Affordable Housing (COAH) approved at its December meeting newly proposed “3rd round” affordable housing regulations.   

The housing employment projections, which are to be used for planning purposes, were posted by the agency on its website at: http://www.state.nj.us/dca/coah/dec07proposal/task1b.pdf
The link above takes you to a 67-page report.  Appendix A, which provides the residential projected growth, begins on page 24 of the report.  To calculate your municipality’s projected residential obligation, look for the column titled, “Net Changes, 2004-2018.”  Then divide that number by four (4).   This is your municipality’s projected residential “growth share” obligation.

Appendix B, which provides the commercial obligation, begins on page 45.   To calculate your municipality’s commercial obligation, look for the column titled, “Net Changes 2004-2018.” Then divide that number by sixteen (16).  This is your municipality’s projected commercial obligation. 
For your total projected obligation, add your projected residential growth share obligation, projected commercial obligation, and your new construction obligation (1987-1999 from Exhibit C.) You may be subject to certain credits about which your professionals can advise.

Please note, however, that we have not verified the numbers provided by NJ.com.    We have spot-checked a number of towns and have found the numbers to be reasonably accurate, but should not be considered definitive or final.

COAH has scheduled five public hearings during the 60-day comment period, which begins on January 22, 2008.    These hearings are scheduled as follows:

All the public hearings are scheduled for 4:00 to 8:00 PM.
By now, we have heard from dozens of municipalities with concerns and questions regarding these new regulations.   The League’s Housing Committee is carefully reviewing these regulations, and we plan on holding a series of meetings so we can hear from you on these regulations and help prepare the League’s comments.   We urge you, however, to review these regulations and analyze their impact on your community.

Formal comments on the regulations (which are available online at: http://www.nj.gov/dca/coah/dec07proposal.shtml) are due by March 22, 2008.    In the meanwhile, questions and comments can be directed to the agency phone or by mail.    If you provide any written comments to the agency, we would recommend copying such comments to the Commissioner of the Department of Community Affairs.
