Re: PBA et. al. v. New Jersey (copy of Judge Feinberg’s Decision)
I wrote to you yesterday to let you know Judge Feinberg’s decision in PBA et. al. v. New Jersey. Judge Feinberg denied the stay and decided that the recently enacted pension and benefit reforms, specifically the mandatory 1.5% minimum all employees must contribute to their health benefits, will go ahead as scheduled.
Judge Feinberg released her written opinion today. In it, she takes the arguments of the unions and refutes them point-by-point, indicating that they are unlikely to succeed on the merits of their arguments.
The opinion is lengthy, but it may be worthwhile to review it with your labor attorney. It contains a thoughtful analysis of the public sector employer/employee collective bargaining relationship, and may be useful to you in the future.
