Re: PBA et. al. v. New Jersey
I wanted to let you know that Judge Feinberg issued her decision today in PBA et. al. v. State of New Jersey. Several different police and fire unions had sought an injunction to prevent the recent pension and benefits reforms from going into effect tomorrow. Specifically, they sought to prevent state and local governments from collecting the 1.5% mandated in the new laws to help defray health care costs.
Today Judge Feinberg announced that she would not grant the injunction, and that the reforms will go ahead as scheduled. She also stated she would issue a more detailed written opinion tomorrow.
The League is pleased and delighted at this decision. As I am sure you know, we have been calling for pension and benefit reforms for some time. The required 1.5% contribution will go a long way towards helping local governments keep costs under control and keep taxes down. In fact, the League submitted a letter to Judge Feinberg supporting the State’s arguments. We think Judge Feinberg came to the right conclusion.
We look forward to working with Governor Christie going forward to ensure the long-term health of the pension and benefit systems.
