RE: League Comments on FCC Cell Tower Rule Proposal Posted On-line

Dear Mayor:

We wrote on Wednesday ( ) to remind you of the upcoming March 5 deadline for filing comments in response to the Federal Communications Commission’s (FCC) proposed cell tower rules.

If adopted, these rules could allow the wireless industry to build on to existing towers, with little or no regard to local planning, zoning or building codes. They could also require unconditional local approval of industry plans to append wireless facilities to utility poles, light poles and road signs.  The proposed rules could even redefine any structure capable of holding a wireless antenna (like a water tank, office building or even a single family home) to be a “wireless tower” and would apply the new FCC rules to all of these structures.
On behalf of the League and New Jersey municipalities, our Special Counsel, Joel Shain, Esq., has submitted comments to the FCC. To assist your municipality in drafting comments, you can access our submission at

If your municipality does submit comments, please forward a copy to the League at

Thank you.

Very truly yours,

Hon. Brian C. Wahler,
Mayor, Piscataway
Chair, NJLM Telecommunications
Study Committee and
3rd Vice President, NJLM
William G. Dressel, Jr.
Executive Director
