Re: COAH Files for Extension of Time Frame
The League would like to update you on new events surrounding COAH. As you may be aware, COAH is required to issue new regulations, after its previous third round regulations were struck down by the State’s highest Court last September. The New Jersey Supreme Court had given COAH until February 26, 2014 to promulgate new regulations which would comply with the Fair Housing Act. Yesterday, COAH filed a motion requesting that the Court extend that time frame until May 1, 2014.
In its motion COAH stated that “substantial process has been made in terms of the review and analysis of the most current data sources and the crafting of the various components of the proposed methodology incorporating those data sources.” However, the agency then stated that more time is needed so that “affordable housing figures for all municipalities can be generated, translated into regulations, and published in accordance with APA [Administrative Procedure Act] requirements.”
The New Jersey Supreme Court has not issued its decision yet on this motion. If the Court does grant COAH’s motion, these new regulations will appear in the June 2nd New Jersey Register. The League will be sure to inform you of any further developments.
