Re: A-3764, Snow Removal Trust Funds, League Resolution 2012-19
Yesterday, the Assembly Homeland Security and State Preparedness Committee approved A-3764, sponsored by Assemblyman Ronald Dancer. The League of Municipalities supports this legislation, which permits counties and municipalities to use snow removal reserve funds for clearance of debris following declaration of emergency by President or Governor.
Following Hurricane Sandy, Governor Christie signed Executive Order 111 permitting municipalities, by resolution, to utilize the reserves in their Snow Removal Trust Funds for storm recovery efforts. A-3764 effectively makes the Governor’s Executive Order permanent to allow municipalities and counties, following the declaration of an emergency by the President or the Governor, to adopt a resolution authorizing the use of snow removal reserve for the clearance of debris.
League Resolution 2012-19, “Expand the Use of Snow Removal Trust Funds to Respond to Natural Disasters” was approved at the League Business meeting on December 5, 2012. The resolution calls for the expansion of the authority granted to a municipality under NJSA 40A:62.1, which permits a municipality to adopt a resolution establishing a snow removal trust fund. A-3764 was approved by the Assembly Homeland Security Committee on March 14 and is now second referenced to the Assembly Appropriations Committee. Assemblyman Dancer has indicated a willingness to work with the League to further refine this legislation and so to give local governments needed flexibility in emergencies.
