Re:      DLGS News Update

Dear Mayor:

The Division of Local Government Service’s has issued their most recent DLGS News Update:

Municipal Land Use Law Amended: On August 7, 2013 Governor Christie signed into law P.L. 2013, c. 107 (www.njleg.state.nj.us/2012/Bills/PL13/107_.PDF).  The law amends the Municipal Land Use Law, allowing certain structures to be elevated and repaired without a zoning variance or other developmental approvals.  We recommend having your municipal attorney evaluate this law to determine if any administrative or zoning procedures can be accelerated in your community to assist in the expeditious recovery from Superstorm Sandy.   For more information please see our August 8 Dear Mayor letter.

September 2013 Tax Court Judgments List: The State Tax Court has updated their website www.judiciary.state.nj.us/taxcourt/monthlyjdgmnts.pdf with the new report for September 2013.  It should be noted that you will need to reach out to your town attorney and/or assessor for copies of any stipulations that may have been taken into consideration for these judgments as they will not be listed on the report itself.  Please take note that the report is searchable by municipality. CY2014 Fire District Budgets: Fire District budget documents are now available for downloading on the Division of Local Government Services' web site at www.nj.gov/dca/divisions/dlgs/programs/au_budgets.html#3.  Users can view and download the following items: Budget Excel Workbook (including Supplemental Schedules and Levy Cap Workbook), Budget Package (including certifications, resolutions and transmittal checklist) and Budget Calendar.   Please also review Local Finance Notice 2013-21 at www.nj.gov/dca/divisions/dlgs/lfns/13/2013-21.pdf for further information.

2014 Authority Budget Submission Authority budget documents (Housing and Other) are now available for downloading on the Division of Local Government Services' web site at www.nj.gov/dca/divisions/dlgs/programs/au_budgets.html.  Users can view and download the following items: Budget Excel Workbook (including Supplemental Schedules and Levy Cap Workbook) and Budget Package (including certifications, resolutions and transmittal checklist).  Please also review Local Finance Notice 2013-22 at www.nj.gov/dca/divisions/dlgs/lfns/13/2013-22.pdf, for further information concerning submission of authority budgets.

Vacancy Provision Questionnaire:   Several of the Professional Certification programs administered by the DLGS have statutory vacancy provisions which allow a municipality, county, or other applicable local contracting unit, to appoint a non-certified person to a temporary position.   Although none of these statutes require that local officials seek permission of the Director of the DLGS for the first year temporary appointment, all of them require the Director’s approval prior to a second and sometimes third year appointment.  Local officials are to submit a letter to the Director requesting such approval and are now required that the person being appointed for the second or third year term complete a questionnaire that can be downloaded at the following link:  www.nj.gov/dca/divisions/dlgs/programs/certification_docs/vacancy_appointment_questionnaire.doc.  Please be advised that the questionnaire must be completed and submitted with the letter from the municipality, county, etc., for the Director's review.  No approvals for temporary positions will be granted without provision of these (2) documents.  For questions, please contact the Division's Certification Unit by e-mail to Daniel.Kaminski@dca.state.nj.us or call (609) 292-9757.

Assistant Division Director, Fiscal Administration: The Division is recruiting a senior level management employee to oversee, develop and implement policies regarding the statutory reviews of certain New Jersey local government units; provide technical accounting and financial reporting guidance to staff and local officials; and advise the Director and staff on public financing activities of local units. A complete recruitment announcement is available at the Division's website: www.nj.gov/dca/divisions/dlgs/ Questions may be e-mailed to Assistant Division Director Christopher J. Vaz at christopher.vaz@dca.state.nj.us but applicants must follow application procedure contained in the announcement.  While the closing date for submitting letters of interest and resumes passed as of September 30, the Division is considering re-advertising the positions in the near future, so please contact the Division if the position is of interest.

Chief, Bureau of Authority Regulation: The Division is recruiting a bureau chief to manage the Bureau of Authority Regulation and provide the necessary support to the Director to enforce local public authority and special district finance laws as determined by statutes, regulations, and promulgations of the Local Finance Board.
