The League offers a variety of legal services that I wanted you to be aware of.
The League offers a legal consultation service as part of our Bureau of Municipal Information. All members can access this service free by telephone or email. Our staff attorney, Matthew Weng, who heads the Bureau, provides municipal officials and employees with knowledge and analysis. For legal advice your first call should be to your municipal attorney.
We also maintain a database of several hundred ordinances, enacted by New Jersey municipalities and counties, on a wide variety of topics. If your municipality is considering an ordinance, contact Matthew instead of reinventing the wheel. He can provide you with several different samples to help you craft the ordinance that’s right for your municipality.
Matthew and the League General Counsel Bill Kearns monitor court decisions that may affect municipalities and bring important decisions to the attention of municipal officials. The Staff Attorney monitors proposed state regulations and court rules and prepares comments on those with municipal impact.
The League also considers requests to get involved as amicus curiae in litigation of statewide impact to municipalities. Requests for intervention should come from either the mayor or municipal attorney acting on behalf of the governing body and can be submitted to the League Staff Attorney or General Counsel. The case must be at the Appellate level, and involve a novel question affecting municipalities generally.
The League is involved with amicus intervention before the Council on Local Mandates. Recent legislation allows the League to initiate complaints before the Council on behalf of two or more municipalities. We encourage municipalities to bring to our attention any unfunded mandates you face.
