Re:      Implementation of c. 52, P.L. 2011 Division of Pension and Benefits Notice

Dear Mayor:

The Division of Pension and Benefits recently issued a Certifying Officer letter regarding the new procedures and employer training requirements for the enrollment and/or transfer of employees into the State-administered retirement systems as required by P.L. 2011, c. 52.  

Chapter 52 requires that all enrollments and/or transfers into a New Jersey State administered retirement system, whether by on-line application or paper form, must be certified as follows:

  • At the time of enrollment and/or transfer of any employee, the Certifying Officer must certify that the person is eligible for enrollment in accordance with the statues and regulations of the retirement system.
  • Upon the certification of an enrollment and/or transfer, the immediate Supervisor of the Certifying Officer must approve the enrollment and/or transfer before the application or form may be submitted to the Division of Pension and Benefits.

In addition, the Certifying Officer and the immediate Supervisor of the Certifying Officer will be required to annually certify for each member of the retirement system, that the person enrolled is eligible for enrollment in the retirement system in accordance with the statutes and regulations of the retirement system.

Chapter 52 defines the “Certifying Officer” as the employee who is responsible for submitting information to and performing the duties relating to matters concerning the retirement system with respect to each of the employees of the employing location, as required by law, the board of trustees and the Division of Pension and Benefits.  “Supervisor of the Certifying Officer” is designated by the employing location and is required to be the immediate supervisor of the Certifying Officer.

The new procedures become effective June 19, 2011, therefore, there are immediate actions required by municipalities.  By June 10, 2011 the Employer Database Update Form must be completed and faxed to the Division of Pension and Benefits at 609-633-9297.  The form must be signed by both the Certifying Officer and the Supervisor of the Certifying Officer. 

Once identified by the Division, the Certifying Officer and the Supervisor of the Certifying Officer must complete the required on-line training.  The enrollment training presentations will be provided over the Internet, accessing a link on the Division of Pension and Benefits website, at no charge to municipality.  When the on-line training becomes available, employers will receive a follow-up letter with detailed instructions and will have up to 30 days to access and complete the training.  Because of the differences in the retirement systems, the Certifying Officer and the Supervisor of the Certifying Officer will be required to take separate enrollment training for each retirement system

Until the Certifying Officer and the Supervisor of the Certifying Officer are properly identified to the Division of Pension and Benefits and trained, enrollments and/or transfers received from the local unit after June 19, 2011, will not be accepted for processing.   In addition, the on-line enrollment applications in EPIC will be temporarily disable as of June 19, 2011 until receipt of the Employer Database Update Form and completion of training by both the Certifying Officer and Supervisor of the Certifying Officer.
