LEAGUE FORMS ARBITRATION REFORM COMMITTEE

The League has formed an Arbitration Reform Committee to seek solutions to the out-of-control costs of police and fire arbitration awards and contracts in New Jersey, which is driving property taxes ever-upward.  It is co-chaired by Mayor Gene Feyl of Denville and Mayor Robert Bowser of East Orange.  Its members include:

The Committee has met several times and has adopted a multi-pronged approach, including publicizing the issue through newspapers, working on procedural changes to speed up and streamline the arbitration process, and seeking legislative change.  League Labor Counsel Gerald Dorf has drafted the following proposed amendment to the New Jersey Employer-Employee Relations Act:

The decision of the Arbitrator:

  1. May not award salary increase(s) in excess of P.L. 1976,c 68 (C.40A:4-45 et seq.).
  2. May provide for salary increases limited to the budget cap imposed by the State of New Jersey and/or any lawful adjustment adopted by the Public Employer.
  3. May provide for salary increases limited to the percentage established by the State or the lawful adjustment adopted by the Public Employer, as may be appropriate, on a department salary line basis.

The Committee will have a table in the Atrium at the 2005 League Conference where more information on their activities and the entire subject will be available.
