No COAH: Change for the better?

It would be fair to say that as a group, municipal officials the length and breadth of New Jersey, as well as the League of Municipalities that represents them, have become increasingly alarmed by the widening gap between reality and the mandates of the state Council on Affordable Housing (COAH), which assigns low-cost housing obligations to municipalities and reviews their plans to meet those obligations.

And the pressure to satisfy COAH is intense, because municipalities whose housing plans lack COAH certification are vulnerable to "the builder's remedy," a lawsuit that would seek to have municipal zoning declared invalid and allow much more intense density for multi-family housing development at market rates, with a modest set-aside for low-cost units.
