I.          New Content from the Division of Local Government Services

1.         Reports for each municipality's 2011 Senior Citizen and Veterans' Tax Exemption reimbursement, which was deposited on November 1, 2011, have been posted on the Division of Local Government Services website at  The report shows the breakdown of payment categories, including the Administrative Fee for each municipality.

2.         In accordance with New Jersey First Residency Law the Department of Labor and Workforce Development has posted the "Application for Exemption from the Provisions of N.J.S.A 52:14-7A of the New Jersey First Act."  This form is to be used by individuals seeking an exemption from the residency requirements of the Act.  The form is available at

3.         Local Finance Notice 2011-31 describes the procedures, including timing, for the 2010 Homestead Credit Benefit property tax bill credit.  This benefit, which reflects homeowner 2010 income, will provide a credit on the February 2012 property tax bill.  See our November 3, 2011 Dear Mayor Letter for additional information.

4.         Local Finance Notice 2011-33 "Calendar Year 2012 Municipal and County Budget Cap Information." provides information on 1977 Appropriation Cap COLA rate (3.5%) and information on the State Health Benefits Program (SHBP) increase for calculating the group health appropriation exclusion for the 1977 and 2010 caps.  Information on treatment for emergency appropriations from the "Pre-Halloween Snowstorm" is also included.  See our November 4, 2011 Dear Mayor Letter for additional information.

5.         SHBP Rate Update: The Division of Pensions and Benefits has announced that the Health Benefit Percentage of Premium Calculators on their website have been updated for the new SHBP medical plans and rates for 2012.  The calculators can be accessed at:  Users should keep in mind that because percentages will increase as of July 2012, calculations should be compared for both Phase One and Phase Two percentage amounts.

6.         Local Government SHBP Webinars: The Division of Pensions and Benefits has posted recorded webinars to educate local government employees of SHBP employers on the new SHBP Open Enrollment and the new plan designs.  They can be viewed at  When signing up to view, if you receive a message that you need a codec, please go to and follow the instructions.  SHBP Employers are urged to make this information available to their employees.  Other employers can disregard it.

7.         Fire District Levy Cap Workbook Correction - Capital Lease Update: On November 14, the Division released a revised FY 2012 Budget workbook for Fire Districts.  The revised workbook correctly calculates the treatment of capital leases for the Levy Cap.  If your Fire District budget includes capital leases, please use the revised workbook.  That will ensure a correct Levy Cap calculation.  If your Fire District budget does not include capital leases, you can use the existing 2012 Levy Cap workbook.  The revised workbook is on the Division website at:

8.         The Department of Community Affairs (DCA) recently announced that the Low Income Home Energy Assistance Program (LIHEAP) is now accepting applications for the upcoming heating season which runs from November 1, 2011 to April 30, 2012.  DCA administers this federal program which provides low-income households with money to help pay their heating bills.  Information about the program is available online at or call 1-800-510-3102.

9.         The DEP Bulletin contains a list of construction permit applications recently filed or acted upon by the New Jersey Department of Environmental Protection.  The latest issue was released November 16, 2011.  This issue can be viewed online at:

II.        November 30, 2011 joint hearing on maintenance of water supply and wastewater utilities

New Jersey’s Water Infrastructure: When Success Is the Only Option.  The New Jersey Clean Water Council and Water Supply Advisory Council are holding a joint hearing on Wednesday, November 30, 2011, 9 a.m. to 1 p.m. at the DEP’s public hearing room at 401 East State Street, Trenton, NJ.  The topic is maintenance of water supply and wastewater utility assets owned by municipalities, municipal utility authorities and private-sector utilities.  NJ DEP Commissioner Bob Martin will be speaking along with two other invited speakers.

This topic is of critical importance to our state’s current and future economy, as mentioned in the new State Strategic Plan, while also having significant implications for municipal finances.  For detailed information, including questions for which the Councils are requesting testimony visit the Clean Water Council’s website at  The period for public testimony will begin at about 10:30a.m.  Mayors, municipal administrators and managers, and utility directors and superintendents should consider attending and testifying on these issues.
