Re:    OLS Notes Fiscal Impact S-2795, Inspection of multiple dwellings under State Housing Code

Dear Mayor:

Yesterday the Office of Legislative Services (OLS) issued a fiscal note for S-2795.  As we previously reported (see Dear Mayor Letters of May 6 and May 13), S-2795, would amend the “Hotel and Multiple Dwelling Law” regarding the enforcement of multiple dwelling which would result in these inspections being conducted solely by the State, unless a municipality opts to conduct such inspections pursuant to a contract with the State. 

OLS has determined that the enactment of S-2795 “would result in a decline in municipal revenue and a potential decline in municipal expenditures and State revenue”.  They further found that “municipalities would incur a revenue loss because the bill would prohibit them from charging separate fees for the registration of multiple dwellings and from adopting ordinances requiring periodic inspections in multiple dwellings other than those conducted by the State.  To the extent the municipalities can reduce certain expenditures related to the performance of these inspections, they will experience a reduction in costs as well.”
