Re:      S-1, reforming COAH, has passed both houses

Dear Mayor:

This past Monday, S-1 passed both the State Senate (21-16) and the General Assembly (45-32).  This bill abolishes the Council on Affordable Housing (COAH) and transfers its duties to the Department of Community Affairs (DCA).  The bill also makes other changes to the State’s housing law. 

We oppose this bill in its current form due to the obligations it would impose on municipalities.

For a detailed list of the reasons the League opposes this bill, please see our Mayor’s letter of January 11, 2011.  That letter also contains a link to the League’s calculations on future obligations under S-1, as well as an explanation of how we arrived at those numbers.  We urge you to review these numbers as well as the League’s methodology in calculating them with your planning professionals.

We urge you to contact the Governor’s Office to express your concerns with this legislation immediately and ask him either to issue a conditional veto that addresses these concerns, or to veto the bill entirely.
